[Satellite TODAY 06-21-10] The U.S. Federal Communications Commission has voted to give itself authority to regulate broadband Internet access transmission and determine whether broadband Internet service should continue to be classified as an “information service,” the FCC announced June 17.
    The FCC vote opens a new proceeding and public forum to inquire if broadband could be classified as a “telecommunications service” or as a “third way,” which would leave Internet content and applications unregulated under Title 1 of the U.S. Communications Act.
    The FCC said that the vote is a response to the U.S. Court of Appeals for the D.C. Circuit’s decision in May, which cast doubt on whether the FCC can ensure fair competition and provide consumer protection.
    Dish Network Chairman, President and CEO Charlie Ergen praised the FCC vote in a company statement issued June 17. “Dish Network applauds the Commission’s decision to release a notice of inquiry on the ‘Third Way’ legal approach. We strongly support Chairman Genachowski’s leadership in moving this critical process forward. A sound legal framework is absolutely necessary to preserve a free and open Internet and encourage innovation and investment.”
