[Satellite TODAY 05-17-10] The U.S. Federal Circuit Court of Appeals granted Dish Network and EchoStar’s request for a full-court review of the ruling in the two company’s patent dispute with TiVo, EchoStar announced May 14.
“We believe the issues that will be considered by the full court on rehearing will have a profound impact on innovation in the United States for years to come,” Dish Network said in a statement.
TiVo, a developer of digital video recorders (DVRs), sued Dish in 2004 for patent infringement over a technology that stores and retrieves video. The court ruled in favor of TiVo, awarding the company $104.6 million in damages and interest while prohibiting Dish Network to use the DVR technology.
While Dish paid TiVo the initial court award, it later redesigned and released its DVR software. However, the U.S. District Court of Texas ruled that Dish violated its order of a permanent injunction and ordered Dish to pay TiVo $103 million in additional damages, plus interest, along with about $200 million in contempt sanctions.
