[Satellite TODAY 02-18-10] A DirecTV injunction to temporarily halt Dish Network’s “Why Pay More” TV advertising campaign has been rejected by the U.S. District Court of Manhattan, N.Y., Dish Network announced Feb. 17.
The ad, which claims that Dish Network charges $24 less per month for the same services as DirecTV, began airing Feb. 8.
District Judge Paul Crotty denied DirecTV’s request but left the door open for DirecTV to appeal. “Given that there is more than one reasonable interpretation of the ‘Why Pay More’ ad, the court cannot conclude,” Crotty said in the ruling.
DirecTV said it would continue its legal against its U.S. pay-TV competitor. “We are pleased that the court invited DirecTV to present evidence at a full hearing to demonstrate that Dish’s advertising campaign is deceptive. We will vigorously pursue our lawsuit to prevent Dish Network from attempting to lure customers away from DirecTV through its blatantly misleading advertising campaign,” DirecTV Spokesman Jon Gieselman said in a statement.
